Terms of Service

Bus Stash

These Terms of Service ("Terms") govern your access to and use of the Bus Stash websites, applications, and related services (the "Service") operated by Bus Stash ("Bus Stash," "we," "us," or "our"). By creating an account, clicking to accept these Terms, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which describes how we handle personal information (including that we do not sell your personal information or share it for third parties' independent marketing). If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes you and that organization.

Eligibility

You must be able to form a legally binding contract in your jurisdiction and, if acting for an organization, have authority to do so. You may not use the Service if you are prohibited from receiving services under applicable law.

The Service

Bus Stash provides tools for organizations to manage operational workflows such as tours, runs, requests, receipts, and related reporting. We may add, change, or discontinue features. We strive to keep the Service available but do not guarantee uninterrupted or error-free operation.

Accounts and access

Organizations and their authorized users are responsible for maintaining the confidentiality of credentials and for all activity under their accounts. You must provide accurate registration information and notify us promptly of unauthorized use. Public request features may allow individuals to submit information without a Bus Stash account; those submissions are processed as described in our Privacy Policy.

Fees, billing, and taxes

If you purchase paid features or subscriptions, fees, billing cycles, and payment methods are as shown at checkout, in an order form, or in your account settings. Fees are exclusive of applicable taxes unless stated otherwise; you are responsible for any taxes associated with your purchase. We may change fees for renewal terms with reasonable advance notice where required by law. Failure to pay may result in suspension or termination of access to paid features.

Customer data and your responsibilities

As between you and Bus Stash, you retain ownership of data you submit to the Service ("Customer Data"). You grant us a worldwide, non-exclusive license to host, process, transmit, back up, and display Customer Data solely to provide and improve the Service, enforce these Terms, and comply with law. You represent that you have all rights and consents needed to submit Customer Data, including personal information of your users, staff, or requesters, and that your use of the Service complies with applicable privacy and employment laws. You are responsible for your organization's configuration of the Service, including any integrations or sharing settings.

Privacy

Our collection and use of personal information is described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference. If there is a conflict between these Terms and the Privacy Policy regarding personal information, the Privacy Policy controls.

Our intellectual property

The Service, including software, branding, documentation, and underlying technology, is owned by Bus Stash and its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during your subscription or trial. You may not copy, modify, distribute, sell, or lease any part of the Service except as expressly permitted.

If you provide suggestions or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without obligation to you.

Third-party brands, trademarks, and content

The Service may display or process names, logos, product packaging, images, or other materials that identify third-party products or companies (for example, in receipts, requests, or marketing examples). Those materials are the property of their respective owners. References are for identification, illustration, or operational context only. Bus Stash does not claim ownership of third-party trademarks or copyrighted works, and use on the Service does not imply affiliation, sponsorship, or endorsement by those owners unless we expressly say otherwise.

Acceptable use

You agree not to:

  • Violate any applicable law or third-party rights;
  • Probe, scan, or test the vulnerability of the Service, or breach security or authentication measures;
  • Access or attempt to access data or accounts belonging to other customers, except as expressly permitted;
  • Overload, disrupt, or interfere with the Service or third-party networks;
  • Use the Service to distribute malware, spam, or deceptive content;
  • Reverse engineer the Service except where prohibited by law; or
  • Use the Service to build a competing product or service, or scrape the Service in violation of these Terms.

Third-party services

The Service may integrate with third-party products or services that your organization enables (for example, storage or email). Those services are governed by their own terms and privacy policies; we are not responsible for third-party services or their acts or omissions.

Export and sanctions

You may not use or export the Service in violation of U.S. or other applicable export control or sanctions laws. You represent that you are not located in a country subject to comprehensive U.S. embargoes or listed on applicable denied-party lists, unless authorized by law.

Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL BUS STASH OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF YOU HAVE NOT PAID FEES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Indemnity

You will defend, indemnify, and hold harmless Bus Stash and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your Customer Data, or your violation of these Terms or applicable law, except to the extent caused by our gross negligence or willful misconduct.

Termination

We may suspend or terminate access to the Service if you materially breach these Terms, fail to pay amounts due when due, or if we are required to do so by law. You may stop using the Service at any time. Upon termination, your right to access the Service ends; we may delete or retain Customer Data according to our retention practices and the Privacy Policy. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnity) will survive.

Changes to these Terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. For material changes, we will provide additional notice where appropriate (for example, email or in-product notice). Continued use of the Service after the effective date constitutes acceptance of the revised Terms, to the extent permitted by law. If you do not agree, you must stop using the Service.

Governing law and venue

These Terms are governed by the laws of the State of Delaware, United States, excluding conflict-of-law rules, unless a different governing law is required by applicable mandatory law. Courts in Delaware (or the U.S. federal courts located there, where jurisdiction exists) have exclusive jurisdiction for disputes arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information.

Miscellaneous

These Terms, together with the Privacy Policy and any order form or written agreement referencing these Terms, constitute the entire agreement between you and Bus Stash regarding the Service and supersede prior agreements on the same subject. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to you may be sent to the email address associated with your account.
